1. INTRODUCTION

These Terms and Conditions govern all services provided by Legacy Air (“the Company”, “we”, “us”, “our”) to any client (“the Client”, “you”).

By accepting a quotation, booking a service, or using our services, you agree to be bound by these Terms and Conditions.

2. SERVICES PROVIDED

Legacy Air provides, but is not limited to:

  • Air conditioning installation
  • Air conditioning repairs and maintenance
  • Heat pump supply and installation
  • Refrigeration services (including commercial units)
  • Chiller maintenance

All services are subject to availability and may vary depending on site conditions.

3. QUOTATIONS & ACCEPTANCE

  • All quotations are valid for 7–14 days unless otherwise stated.
  • Quotes are based on information provided at the time and may change after site inspection.
  • Acceptance of a quotation (verbally, electronically, or in writing) constitutes agreement to proceed.
  • Any additional work outside the original scope will be quoted separately.

4. PAYMENT TERMS

  • A deposit may be required before work begins (typically 50% unless otherwise stated).
  • Full payment is due upon completion of work unless agreed otherwise in writing.
  • Late payments may incur interest at a rate of 2% per month.
  • The Company reserves the right to withhold services or warranties until payment is received in full.

5. INSTALLATION TERMS

  • The Client must ensure access to the premises at the scheduled time.
  • The installation area must be safe, accessible, and free from hazards.
  • Any electrical or structural modifications required outside standard installation will be quoted separately.
  • The Company is not responsible for pre-existing faults or non-compliant electrical systems.

6. REPAIRS & MAINTENANCE

  • Repair timelines are estimates and may vary depending on parts availability.
  • The Company does not guarantee that all faults can be repaired if equipment is beyond economical repair.
  • Routine maintenance is recommended but remains the Client’s responsibility to schedule.

7. PARTS & EQUIPMENT

  • All parts supplied remain the property of the Company until paid in full.
  • New parts may carry manufacturer warranties subject to supplier terms.
  • The Company is not liable for delays caused by third-party suppliers.

8. WARRANTIES

  • Installation workmanship is typically warranted for 3–12 months (unless otherwise stated).
  • Manufacturer warranties apply to equipment and components.
  • Warranty will be void if:
  • The system is tampered with by unauthorised persons
  • Improper use or neglect occurs
  • Payments are outstanding

9. CANCELLATIONS & RESCHEDULING

Cancellations must be made at least 24 hours in advance.

Late cancellations may incur a call-out or cancellation fee.

The Company reserves the right to reschedule due to weather, safety, or operational reasons.

10. LIABILITY

  • The Company is not liable for indirect, incidental, or consequential damages.
  • Liability is limited to the value of the service provided.
  • The Company is not responsible for:
  • Power failures
  • Incorrect usage of equipment
  • Manufacturer defects

11. CLIENT RESPONSIBILITIES

The Client agrees to:

  • Provide accurate information regarding the service required
  • Ensure safe access to the property
  • Maintain installed equipment as advised
  • Use systems according to manufacturer guidelines

12. HEALTH & SAFETY

  • All work will be carried out in compliance with applicable safety standards.
  • The Company reserves the right to refuse service if conditions are unsafe.

13. FORCE MAJEURE

The Company shall not be held liable for delays or failure to perform due to events beyond its control, including but not limited to:

  • Natural disasters
  • Load shedding or power outages
  • Supplier delays
  • Labour disruptions

14. PRIVACY

Any personal information provided will be used solely for service delivery, communication, and invoicing, in accordance with applicable data protection laws.

15. GOVERNING LAW

These Terms and Conditions are governed by the laws of South Africa.

17. AMENDMENTS
